Victims’ Rights Amendment

The Victims Rights’ Amendment is sponsored by Senators Dianne Feinstein of California and Jon Kyl of Arizona. The Senators introduced their proposal on January 7, 2003. It will provide under civil law eight specific rights (Feinstein 2006). The Victims' Right Amendment, or VRA, is a proposed constitutional amendment, currently being considered in Congress, that would enumerate various "rights" for crime victims. To become law, the proposed amendment would need two-thirds vote in Congress and has to be ratified by two-thirds of all of the states (ACLU). The basic rights are:

Be protected from the accused offender

Reasonable and timely notice of any public proceeding involving the crime, the release or escape of the defendant

Not be excluded from any public proceeding

Be heard at any public proceedings involving release, plea, sentencing, reprieve, and pardon

Confer with the Government attorney in the case

Be provided with full and timely restitution in law

Timely and accurate information about public proceedings involving the crime, the release or escape of the defendant

Be treated with fairness and with respect for the victim's dignity and privacy

A crime victim is defined as person who is directly and proximately harmed as a result of a criminal offense. If the victim is a minor of less than 18 years, incompetent, incapacitated, deceased, the legal guardians or representatives of that person's estate, family members or persons appointed by the court may assert the victim's right. The person accused may not be a guardian or representative (Feinstein 2006).

Other unique provisions of the proposed amendment are that if there are a large number of victims, “The court must fashion a procedure to provide for the rights of the victims, when the number of victims makes it impracticable to accord all them the rights outlined in the legislation” (Feinstein 2006). The Attorney General within one year of passage must establish regulations to enforce victim's rights and compliance (Feinstein 2006).

The Modern Crime Victims’ Rights Movement began 30 years ago after the 1973 United States Supreme Court decision in Linda R.S. v. Richard D., 410 U.S. 614 (1972). The Supreme Court ruled on the issue if an unmarried woman could seek to the prosecutors’ office from discriminately applying a statute regarding the non-payment of child support. This was by refusing to prosecute fathers of children to unmarried women. The Court’ holding stated that Linda R.S. “ could not demonstrate a nexus between the prosecutor’s alleged discriminatory enforcement of the child support statute and the woman’s failure to secure child support payments, and as such, the victim did not have standing to seek the relief she requested”, in specification the Court stated, “a private citizen lacks a judicially cognizable interest in the prosecution or non prosecution of another” (History). However in further consideration the court provided an outline for a remedy, that Congress could “enact statutes creating legal rights, the invasion of which creates standing, even though no injury would exist without the statute” (History).

On April 3, 1982, 22-year-old Stephanie Roper accidently veered off a dark rural road an evening in Washington, DC. Two men stopped. Stephanie was abducted and taken to an abandoned farmhouse in Maryland. Stephanie was tortured and raped. The two men killed Stephanie, dismembering and burning her body (Kyl 2011).

Stephanie's parents, Vince and Roberta were notified of the initial proceedings. However they were not notified of subsequent continuances. The defendant's defense counsel argued that the parents would be emotional, irrelevant, and would argue for probable cause for reversal if the parents were permitted to appear. The court agreed and Vince and Roberta were not permitted to speak at trial (Kyl 2011).

In congressional testimony in 2002, Roberta Roper stated how that court ruling affected her family: “Like countless other families then and now, we struggled not only with the devastating effects of the crimes committed against our loved ones, but the consequences … of being shut out of the criminal justice system we depended on and trusted ” (Kyl 2011).

At the federal level Congress passed in the Victim and Witness Protection Act in 1982, the first of several pieces of crime victims’ rights legislation. This was an impetus giving greater legislative recognition to the rights of crime victims. Since this time 33 states have amended their constitutions to create Victims Rights. Other states have passed crime victims’ rights legislation that complements a constitutional amendment.

The victim's rights movement has increased it's presence in the last decade on the basis that if criminals are permitted to speak at trial than victims or their lawful representatives should also. Recently on September 6, 2011 Senator Kyl made reference to the Crime Victims Rights Act (CVRA), which was passed five years ago. The CVRA is the most comprehensive legislation ever passed to protect the rights of crime victims. “It established the rights to be reasonably protected and to be notified, present, and heard at critical stages of the legal process.... Most significantly, the new law provides victims with legal standing to enforce these rights, including access to federal appeals courts (Kyl 2011). The CVRA also created crime victims’ rights clinics nationwide that are dedicated to changing the legal culture with respect to victims’ rights. This culture is concerned with providing direct representation to individual victims in criminal court and proceedings. Here the momentum and organization towards a Victim's Rights Amendment is growing (Kyl 2011).

In conclusion, in Payne v. Tennessee , the United States Supreme Court recognized that crime victims are not nameless or faceless in criminal justice system. In his concurring opinion, Justice Scalia stated, “a public sense of justice keen enough that it has found voice in a nationwide ‘victims’ rights movement ” (History). What he referred to is the substance of the right enumerated in the introduction. These form the basis of the Victims Rights Amendment.

“For too long, our court system has tilted in favor of accused criminals and has proven appallingly indifferent to the suffering of crime victims”(Kyl 2011).

Theory is Good But It Does Not Prevent Things From Happening

The emergence of modeling various systems to implement Technological Singularity in itself is unique phenomena. It can be seen entirely as mechanism of statecraft. Prima facie groups as TED University are working with NASA. My position is that Cambridge University has by defection co-opted significant academic and research capabilities.

How is a software programmer or dev going to explain the open human experimentation that has occurred and is still being imposed over my natural person and citizenship?

Developing a fast machine is one issue and teaching leadership and decision making is another.

Currently President Barack Obama exists in a very serious historical and legal bubble that will burst. This will take down a great deal of the History of Singularity. This folly exists because it too is in the same bubble or a subsystem of that bubble. The morally sound position is to argue my rights and the collective rights of the citizens of the world as strongly as possible.

I, as Obama have both surpassed our 50th Birthdays. I am become more aware of mortality and in consequence how corrupt he and his last five predecessors were.

I travel in a very narrow range of legal jurisdictions:

Big Pine - Bishop - Inyo County

Westwood - Lassen County

McCloud - Siskiyou County

Desert Shores - Imperial County

Blythe - Riverside County

These five areas and those jurisdictions that connect these locations will over the next five years to the end of the decade shape the history of the United States and the presidency in a manner never seen.

Westwood and McCloud are separated by about 100 miles. I alternate between these two small communities every other year.

The legal elements of Hate Crime focus on two components 1. Quid pro Quos 2. Hostile Environment. The local persons and tourists do not fathom that this Chemical Assault - Scorched Earth is a storyboarded entrapment. They are being tested for fitness.

An informant personality predominates universally. As seen in a world of 7 billion persons and perhaps 200 nation-states, no one has stood forward.

The local mythologies of the west and High Sierras are ruined in this iconoclastic based crushing of identity.

Consider that a 75 year old grandfather who is dying has a 50 year old son; he has a 25 year old son, he has a one year old son.

This event has run unopposed since June 17, 1987. This grandfather has lost his health and property. His reputation for standing up and leading his family and community are gone.

The son is the exact age as Barack Obama and myself. He two is continuing a history of failure. His son may have never even lived in the real United States. His one year old son is continuing the continuity of inferiority.

Any concept of American Exceptionalism should recognize the summation of damage that has occurred to the human race and the United States.

The thinkers and theorists of Singularity need to raise the level of the performance.

Abstract

I researched into the continuum of faith based practices, rights, and transformations may may occur in the workplace regarding Cross Cultural Management. I researched nine sources: 2 governmental, 2 NGO advocacy groups, 2 faith based writers, 2 sources on faith based accommodation, 1 textbook author, and one United Senator. I found that the history of the United States has a nexus with rights that continues to influence and transform the laws that govern us as the Civil Rights Act of 1964 Title VII. However it appears that faiths of new immigrants are accounting for the requests for workplace accommodation. This has redefined what is considered a recognized belief system. I believe that diversity is reality. Both private and public management must consider and train for the presence in workplace of faith based practices that reflect out changing culture.

Faith in the Workplace: Practices, Rights, and Transformations

Introduction

In the United States faith has had a prominent, interesting, and transformational effect on the values and work ethics that have shaped both the public and private workplace. There is a convergent and divergent evolution of core values and assimilated perspectives that have come to bear on what we practice as faith in our homes and in the workplace. The strong Prudential values of the first colonialists and the more holistic natural belief systems of the Native Americans have facts and counterpoints that have endured, been challenged, and assimilated as waves of immigration bring a more diverse population and faith based practice into the workplace (Carr-Ruffino 2009).

The simple assertion of our forefathers that a belief in God, honesty, and hard work would create a world of morality, reason, and prosperity has not occurred without the establishment of legal rights from the federal government protecting and guiding what practices are legally permissible in our workplaces.

The First Amendment in the Bill of Rights states:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right

of the people peaceably to assemble and to petition the Government for a redress of grievances (Vincent).

Simply put the freedom to think, choose the faith of one’s choice, to live where one feels secure, and to have an appeal heard even if this is a challenge to the government is a cornerstone of this country's legal system and distinguishes the Constitution. Our heritage of religious toleration and rule of law helped establish what is known as democracy today (Vincent).

History

Liberalism emerged through Christianity where moral or natural reason were considered universal characteristics that defined a faith or philosophy. Liberal Arts then flourished in the traditional universities from Europe to the free world. Liberal Studies stressed a comparison of Christianity with another cultural based on morality and reason. In this regard the Liberal Arts desired to free one's mind while still concerning itself with a scholastic search for truth and civic leadership. Currently the focus on education is research and career preparation (Hoeckly). The diversity of faith practices have a very similar moral and intellectual inner structure reflecting traditional pathways in Western Thought. It is from this rectitude that issues were deemed to be right or wrong, rights and duties, or legal or illegal. Although far from the majority, belief and conduct has pertinence to the ordination of society and government. Individuals from a wide range and domain of practices are requesting accommodation and legal protection from the law for their beliefs.

Body

The practice of a system of faith by employees presents a considerable challenge for the employer, employee, and the federal government. With multiplicity of faiths of workers in the United States, the diversity of a changing workforce will bring different practices and rules that have to be adapted to by the work-group under legal rights.

Two of the pivotal legal documents that provide for faith based practices are the United States Constitution and Title VII of the Civil Rights Act of 1964. The First Amendment is the key amendment and guarantees free speech. The 14^th Amendment contains the Due Process Clause. The Constitution provides essentially for two rights. This is the right to practice one's faith and the other is to remain free from a government imposed religion. This fundamental substantive right and protection from the government was upheld in the law of case: The law states that no State shall make or enforce any law depriving any person of “life, liberty, or property, without due process of law,” or denying any person the “equal protection of the laws,” §1, and empowers Congress “to enforce” those guarantees by “appropriate legislation,” (City of Boerne v. Flores 1997).

Americans are used to expressions of disagreement on controversial subjects, including religious ones

On August 14, 1977, President Bill Clinton issued a directive entitled GUIDELINES ON RELIGIOUS EXERCISE AND RELIGIOUS EXPRESSION IN THE FEDERAL WORKPLACE.

The Directive applied to all civilian executive branch agencies, officials, and employees in the federal workplace. This order guaranteed personal religious expression by employees in the federal workplace except where the employee's interest or practice was in conflict with government's obligation of public service. However government agencies were still permitted in their discretion to reasonably regulate the time, place, and manner of all employee speech provided that these regulations do not discriminate on the basis of content (The White House 1997).

The Directive covers faith based employee conduct while in a personal capacity. As such an employee may keep a Bible, Koran, or scripture on one's private desk which may be read during breaks. Also inclusive is the right to display religious messages on items of clothing as long as these messages are permitted in the same extent of other comparable messages (The White House 1997).

There is an increasing diversity of faith being practiced by the American workforce. Out of 1500 faiths, 900 may be seen as Christian, and 100 Vedic. Under equal protection Paganism, and the Church of Scientology have protected status. Paganism may include Druids, witches, shamans, and aspects of Christianity. The Church of Scientology was started in 1954 by science fiction writer L. Ron Hubbard (Digh 1998).

As seen employees filed complaints based on discrimination had risen 9 percent to 1709 in just one year from 1996 to 1997 (Digh 1998).

The employer must reasonably attempt to accommodate an increasingly wide range of requests regarding being able to exercise their right to faith based practices. As such human resource managers must become aware of basic tenets and principles of diverse practices (Findlaw 2011).

For example, in the Islam faith, the followers are known as Muslims. Adherents bow and pray facing Mecca five times per day. Ramadan is the Holy Week where followers fast.

In Sikhism there are elements of from both Islam and the Vedic traditions. The followers are known as Sikhs. The men wear turbans and do not shave (Digh 1998).

An employer who is knowledgeable and able to keep channels of communication open between management and co-workers is more likely to maintain a happy workforce and working environment. Title VII requires employers “to reasonably accommodate . . . an employee's or prospective employee's religious observance or practice" (The White House 1997).

In attempting to accommodate a request, safety is a prime concern. Does clothing jeopardize standards or create risks? The practice in question shall not infringe on the beliefs of co-workers. An employer, in order to obtain an exemption must specify that an accommodation would impose an "undue hardship on the conduct of the employer's business." 42 U.S.C. 2000e(j) (The White House 1997).

Here are two requests and possible resolutions (Digh 1998).

A. A request to trade shifts with another worker may be as reasonable.

B. A request to take a month off for a faith based observance may be seen as a hardship to the employer

Analysis

The United States citizenship imposes rights and duties. With rights we are entitled freedom to think freely and move about. Duties are the legal obligation to respect the law and the rights of others. The evolution of religious freedom is a part of the heritage of the United States. Such continues as rights are discovered from the original framework of the Constitution and Bill of Rights. The First Amendment, the Civil Rights Acts of 1964 especially Title VII provide for religious expression and accommodation. In 1997 President Bill Clinton refocused the need for federal guidelines in the work place concerning faith based practices by ordering the Directive. The Workplace Religious Freedom Act (S. 4046) was introduced on December 17, 2010 by Senator John Kerry. This bill would provide for my flexibility for workers in their dress (Feinstein 2011).

Application

The historical emergence of faith based practices has evolved in the United States under a system of Separation of Church and State. The government in it's wisdom has attempted to recognize the diversity of beliefs that it's citizens practice and it's value in private, public, and economic life.

Religious discrimination in the workplace involves treating an applicant or employee prejudicially because of one's religious beliefs. Protections provide remedies not only to traditional practices as Buddhism, Christianity, Vaishnavism, Islam, and Judaism, but to all who have sincere faith based, ethical or moral beliefs. Federal civil rights protections bind employers of 15 or more persons. Employees have 180 days to file a complaint. Federal employees have 45 days to file a complaint. Marriage or the association of persons who practice faith is also protected (EEOC 2011).

Discrimination is illegal in any phase of employment, as hiring, termination, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment (EEOC 2011).

It is a violation of Civil Rights to harass one based on religion. Conduct can include offensive remarks about one's faith or practices. When the conduct becomes so frequent or severe that it creates a hostile work environment or such creates an adverse employment decision as demotion or termination such is illegal. Those parties who are culpable may be a supervisor, owner, co-worker, or a client or customer (EEOC 2011). Overall the balance of common practice and protected rights has emerged reflecting the interaction of individuals in the workplace and government. When private or public workplaces have not been willing to accommodate faith based requests the question of whether these issues are rights or should have protected status. As the magnitude of these issues emerge they are either reconciled or an intervention is needed by law.

Conclusion

The motility of the world’s population is increasing due to economic and faith based freedom plus political circumstances. As such, expression of one’s faith in practice and symbols is going to occur in the workplace. However, this right does not absolutely extend into the workplace and confer any extraordinary duty on co-workers to participate. Although discrimination is strictly prohibited such exists. As seen employer's should prepare all employees in the workgroup. “Training and education should be provided to all employees regarding the policy and exactly what constitutes discrimination, with training specifically for managers and employees acting in any supervisory capacity on termination procedures, conflict resolution, and observation skills”. (Gandara p.198).

As interests range from politics, business, and faith itself expand, older traditional boundaries will fall. Emergence usually will create increasing complexity to lead and manage. This will likely be reinforced by amending legislation:

Senator John Kerry (D-MA) introduced the "Workplace Religious Freedom Act" (S. 4046) on December 17, 2010. This bill would have amended the Civil Rights Act of 1964 to require employers to make affirmative efforts to accommodate the religious practices of employees, including an employee's practice of wearing religious clothing or a religious hairstyle The Senate has not voted on S. 4046 before the 111th Congress adjourned on December 22, 2010. This legislation must be reintroduced in the 112th Congress (2011-2012) in order to be passed (Feinstein 2011).

Optimizing employee efficiency and happiness is a cornerstone to a stable society. As many firms emerge towards being transnationals from multinational firms it is in their interest to promote diversity in their products, services, and employees. This same diversity is also reflected in the Armed Forces and public administration. As seen the government has a very tenable task to remain neutral, legislate rights but at the same time enforce the violation of infractions strongly and with due process.

Recommendations

Human Resource officers and employer’s must be able to accommodate the changing workplace that faith based diversity brings as well as stay productive. Since there is a difference between management and file, the leadership capacitated to order subordinates should take the initiative to guarantee that the channels of communication are open and that Civil Rights postings remain in clear view. Leadership should be transparent and actively concerned that issues are deliberately considered and dispensed with in conformity to federal and state rights.

Education is a long term solution but to create the best modification in conduct, rules must be enforced. There must be consequences for non-compliance. Both criminal and civil remedies should reinforce infractions against rights. The assertiveness of an employee who believes their rights have been violated should not subject them or their supporters to retaliation (ADL 2011).

Gandara in her recommendations to avoid double recovery due to claims states, “An employer should first assess its company policy regarding workplace harassment and discrimination. If the employer has no policy, it should immediately draft and implement a written one” (Gandara p. 197). (Her complete suggestions will be incuided in the Appendix).

The concept of equality and fair treatment is an integral part of Faith Practices. In turn through history it has had positive and negative effects of both the private firm and government. This trajectory is far from static and the interaction between different forms of social order form cornerstones within our cultural framework. It is in the best interest of good government to make rational decisions to protect conduct that can be perceived to be private that help create a dynamic and just working environment. This will insure leadership and competitiveness domestically and globally as a cultural diverse population enters the American workplace.

Appendix

The Fallacy of a Super Crime

The creation of a Perfect Crime or a crime that is committed and not detected or a crime that is committed and not prosecuted is an intriguing notion. Here on it’s face a naïve reality appears to posit some manner or criminal ingenuity that avoids the detection of the authorities. This does not at all appear likely under concrete world conditions of the 21st century. The most likely scenario of a temporary short run success of coverage is defection under prisoner’s dilemma. This would entail that a very powerful interest would be sponsoring and or condoning such activity.

What is needed is a crime multiplier to implicate the majority of persons in supporting the crime and or the individuals involved in the criminal activity itself. Here the use of defection and quid pro quos are the modus operandi. Intimidation, extortion, and blackmail are also other instruments of racketeering that reinforce the sustainability of the enterprise. These structures in themselves appear to serve the limited interest of a few persons who must criminalize and reward cohorts to prevent themselves from being prosecuted.

Obstructing justice at the courts is integral to establishing a criminal enterprise. If there is no judge willing to sign an order the law is left up to the vigilance of the citizenry if there is any to begin with. Here in this manner cells of de facto code enforcement officials are able to co-op the judiciary and do the bidding of a state planner or other more traditional crime organizations.

The use of ad vericundium, or an appeal to a famous person, a president, pope, rabbi, guru, or imam is a likelihood. A red herring as appealing to a foreign invasion is the traditional choice of military usurpation. Entangling a majority of both important and average families distributes liability. The more people under defection in the government and homeland security forces the more likely the enterprise will be a success.

Controlling the media through a Yellow Brick Road of career paths and access is essential to censorship and sanitization. This is also true for the sworn professions. This is comprised by doctors, lawyers, psychiatrists, and the PhDs of academia. If these persons are hand picked and reinforced with careers’ a very large Supercrime has the cultural foundation to be successful.

These processes and structures were and are in place regarding a Chemical Assault - Scorched Earth attack on the United States that began on this country’s 200th Anniversary on June 17, 1987. This movement was code named Mobilization of Empire and Civilization or MOEC for short. It demonstrates the defection capabilities of the collapse of the British Empire. It appears that Cambridge Law School lawyers are behind the systematic patterns of defection.

Their strategic interest in this act is Gay Marriage and the LGBTi platform. It also appears they wish to expose the mechanism without the original Origin being prosecuted. This planning has been handed off to Los Angeles Police Department - LAPD which contains cells of a Gay Militia. This has resulted in a planned decadence that creates Gay Irrationalism - Gay Know Nothing. What is unique is that in the last century almost every irrational fascist government has been replaced by socialism.

In review, the manifest function of a Chemical Assault - Scorched immediately places into peril the natural persons in the vicinity of the attack. Secondarily, the Constitution and citizenship comprising the rule of law are damaged.

The latent function is who will benefit and who also will bare the cost. Prima facie Western Christian Democracy has received a very strong blow. I am arguing on the premise that a Neo Fascist form of a totalitarian welfare government will emerge with a mix of corporatism, private property, and social welfare for those that are marginalized.

This is very complex syndrome of trajectories that reflect the history of the world and especially that of technology. Herein it is a fact that MOEC is a Cultural Singularity that is being developed as an antagonistic movement to Technological Singularity#. This will severely hamper AI software developers in creating historically accurate and transparent products to create superintelligence. I personally do not believe that in 2045 the discipline areas in the school of Arts and Letters will be transforming the human race with superintelligence.

I am in concurrence with those thinkers of Singularity who view Singularity in the context of machine intelligence and engineering. Hence the bulk of creating should fall to computers engineering other machines, pharmaceuticals, bridges, planes, and other tangible structures and processes

Consider that today in 2011 nearly 1 billion persons are living on a food budget of $1.25 USD. It does not seem probable that these persons will have access to the technological interface to be transformed by Singularity in 2045 or shortly there after.

Today is the opening of the Coachella Music Festival. At least 75,000 persons have paid about $300 USD for three days of alternative rock. This is occurring as part of the
Supercrime.

Higher Structural Levels of Cognition

At this aperture we must introduce the Concept Of Higher Structural Levels of Cognition. This is similar to the childhood parable of The Blind Man and the Elephant. A System is understood completely by the level that has the greatest cognition and control over its subcomponents. This would be the suprasystem. In the human body this is the central nervous system. 4. Fatalistic Suicide: Such is the counterpoint to anomic suicide. Here the individual is excessively regulated. The future and goals are blocked by oppressive discipline. In overly oppressive societies persons prefer to commit suicide than to live within the setting imposed over them.

Egoistic suicide is the opposite of altruistic suicide. Anomic suicide is the opposite of Fatalistic suicide.

In a simple summation, the forces of social control are the military and the police. Such forces are fatalistic. The population is dependent. This is a defining characteristic of Totalitarianism. Every type of suicide involves some level of anomie with altruistic being the least. Here in MOEC fatalistic suicide predominates with egoistic suicide and anomic following. MOEC has also organized it’s human and tangible resources as a virus. This is intriguing as the naming of the system itself as MOEC is only alleged to have been in place no early than the 1880s and most likely from the 1930s. Twenty three years hence into a systematic entrapment of the human civilization through the United States by what appears to be Male Same Sex Male MSM British Scholars from Cambridge University, I feel compelled to begin an overall capstone to MOEC Studies. This is based on prisoner’s dilemma and the creation of an informant personality that would function universally in all truth systems.

This act of invention creates a fatalistic system. It is totalitarianism. Here the intent of this development is to create a state of dependency in the individual to one’s task master. The idea is develop universal defection and then a hierarchy of class stratification to this authorship. It’s beginnings are irrationalist and pre-fascist. This the selling off or alienating one’s right by others in a state planned plutocracy. This activity will and is
simultaneously developed with pairing with differential levels of chemical assault.

This is based on the Deification of the LGBTi platform.

The conflict is based on LGBTi (homosexuality) versus Opposite Sex (heterosexuality) Los Angeles Police Department is the delivery method and whose orientation is LGBTi, mainly MSM on the attack on my person. I clearly represent the opposite sex - straight - heterosexual side.

Cultural Singularity Versus Technological Singularity

Preface

Gaura Purnam or the Appearance Day of Lord of Caitanya occurred this year on March 19, 2011. This is calculated by sidereal astronomy. It was also a perigee moon or Super Moon. Mobilization of Empire and Civilization or simply MOEC has emerged as a Singularity, it develops from a defection model designed in an Organic Cell which is a virus that mimics and develops a cultural syndrome that will make Technological Singularity suboptimal.

One of the strongest perspectives of MOEC is that it is a linear attack against the human race using Cambridge Law School, United Kingdom, United States, California, Los Angeles Police Department, and LGBTi persons as a catalyst to attack the human civilization.

A deeper magnification reveals that planners of Cambridge Law School (most likely male bisexuals), have usurped the state planning of the United Kingdom and run such as a Racketeered Influenced Corrupt Organization. This is a negative manifest function and latent function for the groups supra. It appears that the LGBTi identity is the strongest position this group of individuals would defend.

One view is that this event will be followed by an explosion to ever-greater levels of intelligence, as each generation of machines creates more intelligent machines in turn. Qualification is needed. Ray Kurzweil is quite expert at presenting historical and hardware graphics postulating exponential machine powers. This axiological support for human intelligence, the stated mission goal of Technological Singularity is rational. If 2050 is postulated, only machine speeds and component fidelity appear achievable. An explosion in computer performance and applied technologies will likely occur. How localized or universal is intelligence (Jkiggens 2009)?

Biological man has not changed dramatically in the last 20,000 years as homo sapiens. Since tool making is an extension of the human body and such begins our development of culture transforming ideas and energy from within our body into artifacts into our social and cultural environments; it is not greatly supported that a world of some 9 billion plus persons in 2050 will have technological access to be transformed by The Singularity (Singularity Institute 2011) (U.S. Census 2011):

Currently intelligence is taught in psychology as linear intelligence and crystal intelligence. The first is quantified reasoning as mathematics and objective. Crystal intelligence is the empirical experience gained over time. This currently peaks at age 50.

The interfacing of humans with Applied Intelligence or Artificial Intelligence systems or individual machines does not readily support a transformation of information in intelligence in humans. There is a consideration of S curve limitations in exponential growth. Thinking in a linear manner again does not coincide with the law of diminishing marginal returns and the availability of technology to support and sustain an explosion of universal intelligence (Andrus 2007).

This is refereed to as the Digital Divide. The Global Digital Divide reveals the fallacy of over-simplification in the Singularity Hypothesis. Is it possible for leveling to occur? Here what again is the intelligence explosion referring too?

The G8 countries (Canada, France, Germany, Italy, Japan, Russia, the UK and the US) are home to almost 50% of the world’s total Internet users with 15% of the world’s population. The Asia-Pacific region is has the most pronounced digital divide. Internet penetration ranges from below 1% in Bangladesh, to 65% in Australia and Republic of Korea . The Republic of Korea, Hong Kong (China) and Netherlands in 2004 were three top countries in terms of broadband penetration (Global Digital Divide 2011).

The final position to note is that Singularity is being developed under censorship and sanitization. It is physically possible to achieve a million-to-one speedup in computation. A subjective year would pass in 31 physical seconds. The entire subjective time span from Socrates in ancient Greece to modern-day humanity would pass in under twenty-two hours. Humans also face an upper limit on the size of their brains. The current estimate is that the typical human brain contains something like a hundred billion neurons and a hundred trillion synapses.¹

The study of singularity in it’s perfect or pure form is stated in the positive as in all properly designed disciplines. This is the gentle abstraction and for the good of the human race. It is a test for designing the human race. It appears that Cambridge University wishes to be the Architect of civilization. They are Singularity. These authors are psychopaths. Ironically Cambridge was the top rated University in the world in 2010.

Currently if a small discussion begins on HTML, JavaScript, C#, PHP, or Python. I would state that I like straight HTML and I can see immediately that simply adding text to Python is much easier than the syntax of other formats. HTML is only scripting with very few transition effects relative to other formats but it is easy to fix even by eye without the use of a checker even for a novice.

As stated MOEC is a defection model that also has been designed as a religion. This begins as a cell that encompasses the experiment space of the defection model here are the basic subcomponents. The United States is borrowing 40 cents for every dollar received. The deficit for this year is projected at $1.5 trillion dollars. The United States is in wars in Iran and increasingly facing threats in Afghanistan.

President Obama has yet to recognize a Chemical Assault - Scorched Earth program that began on the 200th Anniversary of the United States Constitution June 17, 1987 in Dover, Delaware home state of Vice President Joe Biden.

Currently the Salton Sea in California is a Scorched Earth. The air and tangible property are also being despoiled from the placing of chemicals I auto engines.

A Gay Militia from Los Angeles Police Department is operating a blackmail and extortion ring that has entrapped Barack Obama. Their strategic interest is Gay Marriage. This trend is developed within ideology as Gay Irrationalism - Gay Know Nothing. Such is directed as a Joe Virus. Here this attack will aim persons and behaviors in the bottom ten percentile at the highest ten percentile to disintegrate social and cultural cohesion.

This is developed by provocateurs who wish to destroy the environment, target individuals, and thus leave later apologist thinkers more able to sanitize and rebuild over a damaged culture. What has occurred is a Chemical Assault - Scorched Earth directed over one person, (myself) that multiplies to attack the whole.

The structure and process of the attack is to deify LGBTi culture and activities. In reduction the baseline are those sexual activities and behaviors used by Same Sex Males and Females. A LGBTi militia is developed in cell(s) to recruit and radiate the conspiracy in nodes.

This history provides data to document the psychological profiles that have been constructed and used to attack and condition individuals and the collective since June 17, 1987.

It appears that a Stockholm Syndrome has been developed and reinforced through RICO styled operations to support a LGBTi Gay Militia. This is essentially a Wizard of OZ styled defection model. It is historical that the president of the United States is extortable and can be blackmailed. Targets as myself are isolated and literally framed from profiling that is static. Impunity from the courts facilitates the dismissing of criminal and civil complaints The authorship in it’s own thinking wished to develop a same-sex platform and radiate such clandestinely and overtly. This is hedonistic and is biased to the preferences of same sex and bisexual males and their tastes. Lesbianism and female bisexuality are used to front the male same sex male MSM authorship, code enforcement, and their informants.

What is emerging increasingly in prominence is the reality to discuss this event as a Crime Against Humanity prosecutable within the United States Federal Court system domestically and through the Universal System and treaties internationally.

A focal perspective is that I am being isolated from full legal and social life. I am alive but alienated from a full cultural life. The main cell that attacked with the full Chemical Assault, about 25 officers, here in the United States are being entrapped themselves as well as their accomplices who are essentially informants and what is popularly called Gang Stalking.

This is a fallacy called Poison in the Well. This began in Earp, California. This is north of Blythe and the Colorado River was hit which runs into Mexico. Such supplies the drinking water to Southern California. Arizona, and Mexico. Tangible goods are also contaminated from the factory. All the bottled water is contaminated. There are several bottled water companies here in Inyo County and this was as good as Evian because it was fresh.

As seen my alienation is due to my being heterosexual male over my entire life. The format was based in part by philosophy professors at Trinity College (The Philosophy - Theology School of Cambridge UK.) I am variable in this Maze Theory based defection pattern. The health and tangible property in the Owens Valley, about Mono and Inyo County is suspect. This area is a Cornerstone for Criminal and Civil prosecution. The Valley is heavily despoiled. Reiterated prisoner’s dilemma can be similar to a game of Cutthroat in billiards. Three or more people attempt to knock in their opponents balls then the object ball to win. The cell of LAPD militants now lead by Dodo believe they can orchestrate play between three persons from outside the game. They do not realize the impunity they now possess will end as costs rise against other cells of their Gay Militia.

I am socially conservative and straight. I have survived every attempt LAPD has made to OUT me. I am clearly heterosexual and strong and clear about this. Criticism of the Nobel Committee in Choosing Barack Obama for the 2009 Nobel Peace Prize

The following critique discusses the criteria used by the Norwegian Nobel Committee in selecting President Barack Obama for it's 2009 Nobel Peace Prize. The material is from an interview of Geir Lundestad, Secretary of the Norwegian Nobel Committee taken by Simon Frantz.

In contrast I have been, in my opinion the world's most severe unrecognized human rights prisoner. I have lived under manifest Chemical Assault – Scorched Earth since the 200^th Anniversary of the United States, June17, 1987 in Dover, Delaware. It is from this perspective that I am challenging the Nobel Peace Organization as to their legitamcy and if they are indeed following the will of Alfred Nobel as is assertiveley claimed here by Geir Lundestad.

Concrete Events in 2008

Barack Obama took office on January 20, 2008. At this time I was living in Desert Shores, CA along the Salton Sea. The lake itself was contaminated as were the stores where I had to purchase food. The food products themselves had to be chemically despoiled from the factories. It was and is impossible for me to purchase bottled water. Law enforcement officials did and will pour chemicals in the plumbing of buildings if I was or am physically in the area. The tap water is therefore poisoned. Air in these structures and homes would also be contaminated through the ventilation. Cars and other sources of combustion engines also had chemicals placed in their fuels to contaminate the air.

I am based out of Big Pine, California. I spend only a few months there as I now transition from the Eastern High Sierras to the Salton Sea – Colorado River, summer to winter, where I am now writing at the present.

In May I moved to Westwood, California which is bout 100 miles north of Reno, Nevada. Several bodies of water, particularly Lake Almanor were contaminated quite severely.

I returned to Big Pine for the month of October. The Owens River Canal was severely contaminated. There are wheat fields that were irrigated and will exist as evidence for quite some time. I was here when the announcement of Obama's selection for the 2009 Nobel Peace Prize was made. I travelled to Blythe, California near the beginning of November.

The Colorado River is ruined.

There are cotton and wheat fields here that are ruined and will also function as evidence.

Geir Lundestad is committing serious fraud and sanitization. The interests of Norway and the Nobel Organization are suspect. Mr. Lundestad has been considered a very serious historian and expert on American and Western European relations.

These interests becomes more of a focal as his so-called research into President Obama's achievements in the preceding year become historically and legally challenged.

Interview

The interview essentially begins with Simon Frantz making summary observations over Barack Obama's selection.

The initial atmosphere surrounding the the announcement of Barack Obama as the winner of the 2009 Nobel Peace Prize was one of “collective shock and and take a breath,” according to Simon Frantz.

The choice of Barack Obama by the Nobel Committee for it's 2009 Peace Prize was met with a range of responses from parties throughout the world. Geir Lundestad responds that there is much approval and that 'this is a wonderful situation to be in.” There have been reactions from all over the world. In making President Obama it's choice, Nobel Secretary Lundestad stated that the selection was made deliberately based on Alfred Nobel's will for accomplishments in the preceding year. There are three criteria which were used:

Fraternity between nations
Reduction in standing armies – vision of nuclear free world – expecting substantial arms control treaties
The holding of peace congresses – modern version is international diplomacy

President Barack Obama has produced a new international climate. This is based on the United Nations not electoral structures stated Lundestad.

The emphasis is on dialog and negotiations. The emphasis is on arms control and disarmament and the zero option. The emphasis is on a new climate agreement with the United States being a very important partner. The emphasis is on democracy and human rights.

Lundestad argues that creating a new climate and defining a new order is a concrete achievement. These are the ideals of the Norwegian Nobel Committee that have been followed for 108 years.

This Nobel Committee in selecting Obama has a “wonderful spokesman for these ideals” and is attempting to give the president support for the ideals of which he is the primary spokesperson, stated Lundestad. Under these circumstances the committee wishes to give Obama whatever support it can.

Simon Franz states that Barack Obama has been in office for less than nine months.

Lundestad asserts that awarding the prize so early is not unprecedented. Nobel's will states that achievements should be in the preceding year. Usually this is not possible but this year with Obama it is possible. Oscar Arias received the prize within for presenting a peace plan within two months.

Simon Frantz argues that Obama is already under high expectations and that this could add to the expectations for one who is under these pressures.

The Nobel Committee will support Obama in the future. The committee is willing to give any support to create concrete ideals. There is no doubt that “there will be failures,” states Lundestad. Once the committee makes it's selection it will continue to support it's laureates in the future.

President Obama does not have to worry that in the future he will awake and that the Nobel Organization will not support him.

Mr. Frantz argues that the United States is at war with two countries.

The Nobel Committee recognizes that the United States is a superpower. It is not trying to dictate concrete acts to the United States. It is attempting to point out the principals for which it stands, Lundestad added.

Obama follows the ideals of the Norwegian Nobel committee very closely. This can be construed as an overt message in selecting Obama for the prize. The prize is not a magic wand. It will not transform the world.

Summary

Simon Frantz's observation that President Barack Obama winning the 2009 Nobel Peace Prize was one of “collective shock and take a breath” is an understatement. For whatever manifest short term benefits the Norwegian Nobel Organization has in selecting Obama for representing the ideals of Alfred Nobel's will the risk in sacrificing justice in equal treatment to other natural persons and states is very disturbing. There is also the negative future externality to the Nobel Peace Prize itself.

The use of non-military grade chemical weapons is and has been quite severe. The past five United States Presidents:

Ronald Reagan
George H.W. Bush
William Clinton
George W. Bush
Barack Obama

have been blackmailed and extorted by the use of non-military grade chemical assault. The panorama of essentialist thinking by Ronald Reagan and Ayatollah Khomeini has developed a polarization in diplomacy to the present. Jimmy Carter pursued a mechanistic approach using an idealistic and pragmatic diplomacy. Regardless the emergence of free trade even though the GATT Rounds failed lead to economics based on flexible currency, balance of trade, and counter-cycle federal reserve banking as overt weapons of choice in creating and maintaining the Old World Order.

My rights to citizenship and legal person under the UDHR, ICCPR, and CAT are not recognized by the Norwegian Nobel Committee or President Obama and the United States.

The Convention Against Torture was ratified by President Clinton in 1994.

Geir Lundestad argues that Barack Obama has created fraternity between nations. The Colorado River has headwaters in the State of Arizona it is a main source of agriculture and drinking water for Los Angeles, San Diego, and Mexico. I have to BATHE AND WASH MY CLOTHES IN POISON.

Geir Lundestad has cited arms reduction and zero options. This in particular is nuclear arms. If he had done the research he had claimed he would have found a world of chemical assault – chemical stalking carried by what is now called homeland security officers viz. Policemen.

The awarding of the 2009 Nobel Peace Prize to Barack Obama as a wonderful spokesman for these ideals sets an alarming precedent for a spokesman for Change. Are we ready for Change? Why should we continue doing the same thing again and again.

The circular folly is perhaps one the oldest informal fallacies and certainly the most used in power plays. Here I do not see the concrete transformations in progress in spite of Barack Obama superficially appearing able and willing to implement actions on the side of democracy, peace, and human rights. I am 48 years of age, exactly one day older than Obama being born August 3, 1961 in Roswell, New Mexico.

My life is held in the balance as I endure systematic human rights violations. The United States is an Informant State. I would trust a reading of the United States Constitution to restore my primary rights and identify culpable actors.

I do not believe that Geir Lundestad or the Nobel Organization are partners in good faith in recognizing the suffering of millions of persons and the despoiling of territory vastly larger that the country of Norway here in the United States.

I finish writing this critique recognizing that the theater of defection and interests in concrete political realities is quite pronounced. The denial of writ of certiorari cv 98-7015 was yesterday January 18, 1999. This date, as happened yesterday is Martin Luther King Jr. Day. Soon in the future in spite of the claims of Geir Lundestad, an accurate discovery into the record of President Barack Obama will be made. The politics of sanitization and censorship for which he has emerged as a symbol is no more than Poison in the Well.

The Stone Unturned: A Critique of Obama’s Nobel Prize Acceptance Speech

President Barack Obama has won the 2009 Nobel Peace Prize. The texture will remain open as to whether the interests of the Nobel Organization bear out in making this choice in the history of the human race. The honor was rationalized on the belief that creating an environment for dialog concerning nuclear disarmament vis a vis with Mahmoud Ahmadinejad of Iran justified the prize in spite of a lack of tangible accomplishments that usual accompany laureates.

The Nobel Committee has stated that it researched many qualified candidates from the past year and the winner was Obama.

I was camping in a field south of Big Pine, California on October 9 when news of the prize broke. I have been living under constant attack since April of 1986, with totalitarian electronic surveillance and Chemical Assault - Scorched Earth since June 17, 1987, the 200^th anniversary of the United States Constitution.

My alienation has engendered the most successful censorship and sanitization of history to date. My argument is that the manifest concrete condoning of my systematic torture will transform the thinking and methodologies of leadership and warfare.

I will end my preface on the panorama of the 2009 Nobel Peace Prize with closing statements of the president:

Somewhere today, in the here and now, in the world as it is, a soldier sees he's outgunned, but stands firm to keep the peace. Somewhere today, in this world, a young protestor awaits the brutality of her government, but has the courage to march on. Somewhere today, a mother facing punishing poverty still takes the time to teach her child, scrapes together what few coins she has to send that child to school -- because she believes that a cruel world still has a place for that child's dreams.

The Stone Unturned: A Critique of Obama’s Nobel Prize Acceptance Speech

After acknowledging his audience Obama spoke the following words:

I receive this honor with deep gratitude and great humility. It is an award that speaks to our highest aspirations -- that for all the cruelty and hardship of our world, we are not mere prisoners of fate. Our actions matter, and can bend history in the direction of justice.

A centerpiece of Obama’s speech is that he was awarded the prize while he is acting as commander in chief of a nation in war. He argued that this war was an act of collective security not just one nation defending itself in a unilateralist posture.

But perhaps the most profound issue surrounding my receipt of this prize is the fact that I am the Commander-in-Chief of the military of a nation in the midst of two wars. One of these wars is winding down. The other is a conflict that America did not seek; one in which we are joined by 42 other countries -- including Norway -- in an effort to defend ourselves and all nations from further attacks.

Obama then proceeded to discuss the basic concept of jus belle or just warfare. This also acknowledged the emergence of international law and human rights. Obama also began to foreshadow another key concept of his doctrine: the building of institutions to create peace. After recapitulating the past centuries failures of two world wars and the League Of Nations, the president also pointed out that war is not the conventional use of armies and alignments but now of terror. Here we have a convergence which begins to demonstrate the apperception and lack of volition of both the Nobel Organization and Barack Obama.

And yet, a decade into a new century, this old architecture is buckling under the weight of new threats. The world may no longer shudder at the prospect of war between two nuclear superpowers, but proliferation may increase the risk of catastrophe. Terrorism has long been a tactic, but modern technology allows a few small men with outsized rage to murder innocents on a horrific scale.

Presidents usually are evaluated on their skill on identifying and solving the nation’s problems. This has lead to the first presidents being seen favorably as Washington, Jefferson, and Lincoln being seen in a positive light. This is due to state creation and human rights. Due process is a right. Persons who often plead in forma pauperus use the 14^th Amendment, the due process clause, to civilly petition the government as a last resort if criminal actions are not recognized by the state itself on it’s citizen’s behalf. This amendment reflects the rise of Jim Crow Laws in the Deep South after the Civil War. Obama points out that he does not have solutions to war. Obama quotes Martin Luther King Jr. to reason that, “Violence never brings permanent peace. It solves no social problem: it merely creates new and more complicated ones."

Following this statement a crest of tension or arsis is presented :

But as a head of state sworn to protect and defend my nation, I cannot be guided by their examples alone. I face the world as it is, and cannot stand idle in the face of threats to the American people. For make no mistake: Evil does exist in the world. A non-violent movement could not have halted Hitler's armies. Negotiations cannot convince al Qaeda's leaders to lay down their arms. To say that force may sometimes be necessary is not a call to cynicism -- it is a recognition of history; the imperfections of man and the limits of reason.

Here I will state that Obama confirms his role as a sophist, he also introduces his apologetics, of a consequentalist nature, invoking a strongman posture derived from Plato’s Thrasymachus in his Republic. Here I am not changing the subject. Obama speaks of al Qaeda. I am speaking of censored violence and EVIL here against myself in the United States and other living life.

Obama is correct in that self defense after exhausting resources against a recalcitrant enemy is justified. He is grossly in error in his axiology and duties as Head of State and Commander in Chief of the United States.

Obama then begins to build another arc of tension with his historical acknowledgment over structures and processes and the concrete zeitgeist that the United States exists in at the present time.

I raise this point, I begin with this point because in many countries there is a deep ambivalence about military action today, no matter what the cause. And at times, this is joined by a reflexive suspicion of America, the world's sole military superpower.

The president seeks to then build consensus over the role the United States is performing by stressing that the sacrifices American service persons have made is in the collective interest. His statement that the future’s children and grandchildren will be better if others offspring are secure is hypocritical. I am under severe CHEMICAL ASSAULT - SCORCHED EARTH. I HAVE NEVER MARRIED AND HAVE NEVER HAD CHILDREN. This statement is simply an abstract straw man. There is severe fallacy of separation from this idealistic statement and the real world condition under which natural persons and citizens exist in the United States.

But the world must remember that it was not simply international institutions -- not just treaties and declarations -- that brought stability to a post-World War II world. Whatever mistakes we have made, the plain fact is this: The United States of America has helped underwrite global security for more than six decades with the blood of our citizens and the strength of our arms. The service and sacrifice of our men and women in uniform has promoted peace and prosperity from Germany to Korea, and enabled democracy to take hold in places like the Balkans. We have borne this burden not because we seek to impose our will. We have done so out of enlightened self-interest -- because we seek a better future for our children and grandchildren, and we believe that their lives will be better if others' children and grandchildren can live in freedom and prosperity.

In the context of being a commander in chief Obama acknowledges what apparently seems counter-intuitive that war is necessary and also a folly. Here there is a materialist self evident truth that human systems are differentiated and that the benefit to cost ratios determine correct leadership choices. Obama invokes a trajectory from Kennedy to make a concrete statement in the direction and goals in which he intends to lead the United States and the world.

So part of our challenge is reconciling these two seemingly irreconcilable truths -- that war is sometimes necessary, and war at some level is an expression of human folly. Concretely, we must direct our effort to the task that President Kennedy called for long ago. "Let us focus," he said, "on a more practical, more attainable peace, based not on a sudden revolution in human nature but on a gradual evolution in human institutions." A gradual evolution of human institutions.

Before Obama clarifies this activity, he recapitulates his role as a sovereign head of state. This is centered on the unilateral right to use deadly force. This is an issue that deeply divides the United States and the majority of the world. He reasserts his position as Thrasymachus the sophist in Plato’s Republic. Hence, that Justice is in the interest of the stronger, to help our friends and harm our enemies. Plato’s Socrates’ answer is that Justice is in the interest of the weaker. Here this means rights. Justice means that the good or the strong take up the argument for the weak and defenseless to see the good or truth. This is the Greek philosophic basis for human rights of the UDHR and the Bill of Rights of the United States.

Here my criticism is based on concrete objective empirical history. This is not stating a correct abstract principle. Obama and the analysis must not be totalitarian and isolate reality from perception. (I am writing along the Colorado River near Blythe CA - Ehrenberg AZ, and the river is despoiled.)

To begin with, I believe that all nations -- strong and weak alike -- must adhere to standards that govern the use of force. I -- like any head of state -- reserve the right to act unilaterally if necessary to defend my nation. Nevertheless, I am convinced that adhering to standards, international standards, strengthens those who do, and isolates and weakens those who don't.

Furthermore, America -- in fact, no nation -- can insist that others follow the rules of the road if we refuse to follow them ourselves. For when we don't, our actions appear arbitrary and undercut the legitimacy of future interventions, no matter how justified.

The unattractive truth emerges. Barack Obama states in the affirmative that the use of deadly force is justified against a sovereign nation-state is culpable against attacks against it’s own citizens and natural persons living in it’s territory.

And this becomes particularly important when the purpose of military action extends beyond self-defense or the defense of one nation against an aggressor. More and more, we all confront difficult questions about how to prevent the slaughter of civilians by their own government, or to stop a civil war whose violence and suffering can engulf an entire region.
I believe that force can be justified on humanitarian grounds, as it was in the Balkans, or in other places that have been scarred by war. Inaction tears at our conscience and can lead to more costly intervention later. That's why all responsible nations must embrace the role that militaries with a clear mandate can play to keep the peace.

Duplicity is the lack of respect of persons. Here the world is condoning the attack in the United States as most of the free world is dependent on the United States to maintain the peace and economic prosperity. This type of mass defection is irrational. It is however the main choice of action where the immediate short payoff is for everyone to defect to receive a payoff in prisoner’s dilemma. Obama divides the argument. Unity is strength and fragmentation is weakness. The best efficient optimization is to uphold the Bill of Rights and stop the Chemical Assault - Scorched Earth here. Then, international security of which the United States has lesser control and whose legal jurisdiction is more questionable will be STRONGER!

America's commitment to global security will never waver. But in a world in which threats are more diffuse, and missions more complex, America cannot act alone. America alone cannot secure the peace. This is true in Afghanistan. This is true in failed states like Somalia, where terrorism and piracy is joined by famine and human suffering. And sadly, it will continue to be true in unstable regions for years to come.

Obama is preparing to close his presentation. In doing so he clearly positioning himself as a hypocrite who states one thing and does the other. Obama exhorts a legal - moral posture for other nation-states and natural persons while he looks the other way as a Prefect Dictator while secret police actions carry out abuse against his own citizens.

Let me make one final point about the use of force. Even as we make difficult decisions about going to war, we must also think clearly about how we fight it. The Nobel Committee recognized this truth in awarding its first prize for peace to Henry Dunant -- the founder of the Red Cross, and a driving force behind the Geneva Conventions.
Where force is necessary, we have a moral and strategic interest in binding ourselves to certain rules of conduct. And even as we confront a vicious adversary that abides by no rules, I believe the United States of America must remain a standard bearer in the conduct of war. That is what makes us different from those whom we fight. That is a source of our strength. That is why I prohibited torture. That is why I ordered the prison at Guantanamo Bay closed. And that is why I have reaffirmed America's commitment to abide by the Geneva Conventions. We lose ourselves when we compromise the very ideals that we fight to defend. (Applause.) And we honor -- we honor those ideals by upholding them not when it's easy, but when it is hard.

Obama signals that the arrival of his thesis is to begin. This is a three step plan to achieve future peace. This will reconcile the tensions he evokes. He ends his acceptance with some embellishments in the style of a codetta. Here there is tough talk about nuclear weapons and human rights that he claims will be backed up in deeds. He states that he can cooperate with Russian President Medvedev in constraining Iran and it’s nuclear program which has pitted Mahmoud Ahmadinejad of Iran and Obama in brinksmanship similar to Kennedy during the Cuban Missile Crisis during the early 1960s.

First, in dealing with those nations that break rules and laws, I believe that we must develop alternatives to violence that are tough enough to actually change behavior -- for if we want a lasting peace, then the words of the international community must mean something. Those regimes that break the rules must be held accountable. Sanctions must exact a real price. Intransigence must be met with increased pressure -- and such pressure exists only when the world stands together as one.

It is interesting to note that Obama states that he favors a approach to disarmament in his détente. It is not clear how much diplomacy will occur between the United States and Iran and Korea. To do such would escalate the prestige vis a vis with the United States. This is not desirable to the nuclear and economic status quo. Here is another recurring concrete act of hypocrisy. How can Obama keep these two actors clean and not game the system when HE IS GAMING THE SYSTEM ON CHEMICAL ASSAULT - SCORCHED EARTH.

Barack is handling his oratory with kid gloves. As street smarts and unattractive realities persist - If you play the game, YOU BECOME THE GAME…

But it is also incumbent upon all of us to insist that nations like Iran and North Korea do not game the system. Those who claim to respect international law cannot avert their eyes when those laws are flouted. Those who care for their own security cannot ignore the danger of an arms race in the Middle East or East Asia. Those who seek peace cannot stand idly by as nations arm themselves for nuclear war.

The same principle applies to those who violate international laws by brutalizing their own people. When there is genocide in Darfur, systematic rape in Congo, repression in Burma -- there must be consequences. Yes, there will be engagement; yes, there will be diplomacy -- but there must be consequences when those things fail. And the closer we stand together, the less likely we will be faced with the choice between armed intervention and complicity in oppression.

Obama’s second point is a manifest - latent function operating in unity.

This brings me to a second point -- the nature of the peace that we seek. For peace is not merely the absence of visible conflict. Only a just peace based on the inherent rights and dignity of every individual can truly be lasting.

Obama on defining point two also refers to differentiation and externalities. He is tacitly acknowledging to his audience that his leadership will have to elements of pragmatism and sin to become good tradeoffs. I am not begging the question or creating a red herring and defeating such. One has to acknowledge the CONCRETE. Barack Obama is going to enter nuclear disarmament without establishing his legitimacy on internal problems as my persecution which is also an act of warfare. If the United Kingdom is the Origin and authorship than we are at War with a external democracy something he early states the United States has never done.

…There's no simple formula here. But we must try as best we can to balance isolation and engagement, pressure and incentives, so that human rights and dignity are advanced over time.

Obama’s point three affirms socio-economic justice as well as the right to legal person before one’s government. He directly mentions the need for clean medicine, shelter, and clean water is something I ABSOLUTELY DO NOT HAVE. THE COLRADO RIVER IS CLEARLY CONTAMINATED AND HEADED INTO MEXICO!

It is undoubtedly true that development rarely takes root without security; it is also true that security does not exist where human beings do not have access to enough food, or clean water, or the medicine and shelter they need to survive. It does not exist where children can't aspire to a decent education or a job that supports a family. The absence of hope can rot a society from within.

Barack Obama recapitulates the thesis.

Agreements among nations. Strong institutions. Support for human rights. Investments in development. All these are vital ingredients in bringing about the evolution that President Kennedy spoke about. And yet, I do not believe that we will have the will, the determination, the staying power, to complete this work without something more -- and that's the continued expansion of our moral imagination; an insistence that there's something irreducible that we all share.

Barack then asserts with his oratory skills that substance is the principle that is behind all of assumptions and activities of which he will lead into the future. He is also a man of faith and morality which is essential for the success of the human race.

For if we lose that faith -- if we dismiss it as silly or naïve; if we divorce it from the decisions that we make on issues of war and peace -- then we lose what's best about humanity. We lose our sense of possibility. We lose our moral compass.

...Let us reach for the world that ought to be -- that spark of the divine that still stirs within each of our souls. (Applause.)

Barack Obama closes his speech by pointing out the faceless average persons who will not get recognized for their sacrifices in the context of war and peace. His role is that of a sovereign head of state and commander in chief.

Let us live by their example. We can acknowledge that oppression will always be with us, and still strive for justice. We can admit the intractability of depravation, and still strive for dignity. Clear-eyed, we can understand that there will be war, and still strive for peace. We can do that -- for that is the story of human progress; that's the hope of all the world; and at this moment of challenge, that must be our work here on Earth.
Thank you very much. (Applause.)

Summary

The panorama in which President Barack Obama has received the Nobel Peace Prize for 2009 contains a very deep and compelling concrete history that the Nobel Organization nor Obama and the United States has recognized.

His being awarded the Nobel Peace Prize also confirms that sovereign boundaries are only for the weak and not the powers that keep one in awe. Hobbes' Leviathan states that this struggle is a battle of All against All.

Obama is acting in folly by not opposing CONCRETE EVENTS IN THE UNITED STATES. This is evil and these acts of impunity are beyond the legal punishments for good and evil by constitutional processes of the United States and international standards of credibility.

The folly of totalitarian isolation does not substantiate creating an environment for nuclear deterrence, diplomacy or human rights.

The entrapment of Obama and myself involves the transformations that occur between a sovereign and the citizen under his protection.

The context of Barack Obama’s acceptance speech glosses over the realities of the sworn duty of the president of the United States. This is to protect the United States Constitution, citizens, and the territory of the homeland.

Obama argues that there are legal rules and consequences await for those who do not conform to these accepted norms of behavior. Where does the United States’ complicity in gross and egregious acts of Chemical Assault - Scorched Earth configure in the Obama Doctrine being unfolded before an expecting world?

If philosophy and projecting ideals would solve the problems than this event would of not happened and there would be a Palestinian State or at least a bad peace. The concrete world shows that these public displays of statesmanship are usually only tactics used to buy time to rebuild for the fight. Here we are dealing with the arc of lifespan. My condition is debilitating and one if duress as are the woman and children in refugee camps in Darfur or a child awaiting food in Somalia. I announce that I am STATELESS PERSON within the boundaries of the country to which I was born a citizen on August 3, 1961 in Roswell, New Mexico. This is one day prior to the ruse affecting Barack Obama’s birth one day hence in Honolulu, Hawaii.

Primary law defines one substantive rights under citizenship. Secondary law defines the duties which obligate one to recognize rights of citizenship. This is also particular to code enforcement officials who are citizens first and duty bound competent authorities secondarily.

Totalitarianism occurs when the interests of the Secondary law is placed before the Primary Law.

Accountability should await Obama under the Bill of Rights and the United States Federal Code. The international community should invoke the Convention Against Torture which President Clinton ratified in 1994.

Supra - Irrationalism

Supra irrationality or irrationalism is an emergent subject pertaining to the philosophical orientation or psychological equilibrium of individual and collective actors at the international, national, and local levels. There is a direct but inverse relationship to super rationality which is a game theory prisoner's dilemma approach. Here two supra rationality players by logic and reason will choose to cooperate exactly to the betterment of each.

Supra irrationality will give demonstratable explanations to acts that appear to be fragmented and disjointed. Here there is usually a dissymmetry of information and power and control. One actor wishes to further one's benefit usually by deception, force, and or coercion. This is also true for the punishment or degradation of another player. The concept of under the color of law is invoked. Usually there is some predetermined plan or goal that is wished to be implemented. Herein the use of the word supra is clarified. There is usually an external system that is irrational that is dictating this mode of consciousness to a subordinate dependent party. If it is an individual or group the fatalistic higher party is invented or has ceased operating and the fatalistic-dependent relationship continued to justify psychic content and activities.

The concept of Higher Structural Levels of Cognition and the Culture of Impunity has to be considered.

At all levels of a system or hierarchy the following are true.

In prisoner's dilemma supra irrationality is never optimal.
In this approach two or more players always choose defect. As in simple prisoner's dilemma the prosecutor will always use betrayal against two other players. Here is where the supra irrationality has it's decisive distinction the principle of the descending operation is wrong, immoral, or illegal.
In a phenomenological perspective of an individual player it may be marginal in the short run. The belief is that continued defection will yield the greatest benefit.

The direct implication here is of morality, leadership, the color of authority, and the setting especially of where one system is attempting to transform another to it's interest. The theories of deontology and consequentialism are in conflict. Supra irrationalism has a marginal advantage to occur in benefit cost ratio where an individual or minority can be sacrificed for the majority or whole. This is an opening that irrationalist actors would seek to exploit.

Conversely antinomianism or lawless in the name of God is also a probability. This will have direct impact on theories of war, genocide, and international relations. In a simple truth table if in a hierarchical set of ten elements in column p as true and b false; it is possible for a controller to engage two subordinate players in prisoner's dilemma to choose all ten b or false choices. This would invert the system. It is possible that if there were ten players one as the controller would be wishing to implicate a status quo in a hierarchy.

There is a direct implication here in eternal law with revisionist philosophy or state or police control over philosophy.

The classic stoning or the story of The Lottery clearly illustrates the concept of supra irrationality as it attempts to transform, systematize, and institutionalize a process and structure.

The simple story of The Lottery or a Stoning provides as excellent model as to how supra irrationality attempts to organize agents and thinking in a system and controls such. Here formal fallacies of reason as the converse and reverse converse accident unfold. Number 4 picks up a stone and threatens Number 3 in that he must pick up a stone and threaten Number 2. Number 3 agrees and Number 2 is approached. Number 4 and 3 now approach Number 2 and threaten such that he must approach Number 1. Number 3's argument is that he must or Number 4 will stone him. Number 1 is approached and threatened. He attempts to stone Number 4 and is killed by Number 4, 3, and 2.

Here in a basic format we observe a circular folly of under the color of law or authority. There are also Racketeered Influenced Behaviors as intimidation of a witness, extortion, blackmail, hostaging, and murder.

The Russian empire has a long history of censorship extending from the 1850s under the Tsar. It was easy to co-op this practice by the Bolsheviks after the 1917 Revolution. The effects of this activity persisted into the 1980s. In this sense the Russian peoples have endured the longest censorship this century reflecting policy of the USSR.

In the spring of 1918 a decree separated the church and state. The central censorship office was to become known as the Glavit in 1922. This office had absolute power to suppress political dissidence in the arts and media.

Lenin and Trotsky however did permit some writers and artists creative freedom under stipulations that they would not engage in civil dissident acts.

A small avante garde movement emerged between 1915 and 1932. The permissiveness of freedom would soon end under Stalin. Under this government a more systematic methodology to preventing authorship, printing publishing, and importing literature occurred.

Deindividuation Theory and Violence

Deindividuation theory attempts to define abnormal behavior from the social dimension of the crowd. It is compelling while such is still emergent in its conception. How the individual comes to act in extraordinary manners in non-normative instances has yet to be reconciled. The irrationalist compulsive behavior which does consider the consequences of its act only desensitizes an already alienated human culture. In its continuation it also begs the question of how civilized homo sapiens exists.

Deindividuation Abstract

Deindividuation theory is a social psychological account of the individual in the crowd. Deindividuation is a psychological state of decreased self-evaluation, causing anti-normative and disinhibited behavior. The impact of deindividuation theory in science and society (especially 20th century politics) make it one of social science's more influential contributions. Deindividuation theory is rooted in some of the earliest social psychological theorizing, more than a century ago. It seeks to explain the apparent transformation of rational individuals into an unruly group or crowd. It posits that the group provides an environment in which the individual --submerged and anonymous -- suffers from a loss of self-awareness (Zimbardo, 1969). Deindividuation hinders reflection about the consequences of actions, rendering social norms impotent while increasing suggestibility to random outside influences. The theory has been invoked to account for a range of phenomena such as collective behavior, behavior in online groups and in CMC, and the results of the classic Stanford Prison Experience. Despite its status and impact, empirical support for deindividuation theory is minimal. Recently, this lack of support has been attributed to the faulty assumption that crowds cause a loss of self. Instead, it has been proposed that deindividuation marks a transition from individual identity to social dimensions of the self. This transition to a social identity may increase responsiveness to social norms particular to the crowd, instead of decreasing responsiveness to generic social norms, as suggested by deindividuation theory.

What is Deindividuation

According to deindividuation theory, the psychological state of deindividuation is aroused when individuals join crowds or large groups. The state is characterized by diminished awareness of self and individuality. This in turn reduces an individual's self-restraint and normative regulation of behavior. In social psychology, deindividuation is a major theory of group behavior: it provides an explanation of collective behavior of violent crowds, mindless hooligans, and the lynch mob. In addition, deindividuation has been associated with other social phenomena such as genocide, stereotyping, and disinhibition in other settings such as computer-mediated communication. Below, the theoretical evolution of deindividuation is sketched, followed by a brief impression of the empirical support for this theory. Finally, recent research is discussed, which argues for a reconceptualization of deindividuation: It appears deindividuation is not a loss of individual identity, but may be better construed as a transition to a social identity.

Culture of Impunity

The culture of impunity has been assailed far and wide by those individuals and institutions capacitated to uphold both individual and collective rights. The alienation of this duty under the civil state reveals an important lack of unity and or linkage with the culture of natural humans that comprise the nation within the state. It is a certainty that we as humans are individuals before we are a collective of which has the family for it’s first domain. This is to state that the individual must also be responsible for one’s input into the culture (Rousseau).

Here I will discuss culture as the creation of a culture of impunity as an emergent worldview, a dysfunction of those manifest cultural processes that have arisen from our mal-adaptation and return to be systematically, often at the hands of agents of social control, operational to make us more antisocial in the sense of psychopathy.

Anthropologists claim that through evolution human beings are attempting to classify experiences and then to encode such for communication symbolically. Here the biological nature which has some deterministic basis becomes an external linkage that will develop entropy as all mechanistic linkages will. Here the symbolic linkage of learned beliefs, processes, and artifacts that pertain to a culture are both considered symbolic and material.

Within this framework of an emergent worldview there shall be posited the negative valuation of values, norms, and artifacts have in supporting the culture of impunity.

In continuation of this framework would be the economic basis that both helps the production and consumption of these processes not strictly as a manner of creating wealth and storing such in a value but as a mode in which to manipulate those artifacts, technologies, and processes to foster a culture of impunity.

Totalitarianism seeks to isolate the individual or the group ex-communicado thereby destroying the natural equilibrium that is needed for support from the environment. (In the beginning of 2005 the Darfur/Sudan crisis highlights this tactic). The alienation of the individual or group if by organized forces external to one supports fatalism as expounds by Durkheim. Here I am stating an adaptation of his suicide theory. The fate and the condition here of the living is more contingent under conditions of realism of a controlling external power over such. In this light these persons are suffering from dependency. Their own autonomous range of choices and activities may be insufficient to remedy their predicament. Here the need of assistance radiates beyond the territory of the instant case.

The fatalistic agents of control have created a lesser of two evils culture of tacit condonement of the existence of serious violations of human rights. The continuum of this pattern appears now to penetrate and taint all those events of which learned persons have come to define culture in the positive.

As natural systems that are open bound towards the environment, humans need inputs to be sustainable. Activities in the Darfur area of Sudan demonstrate that war by other means can be perpetuated with impunity from the international communities. Polemics and missives are not in themselves a remedy. It appears that perpetrators of these acts assume carte blanche that interference with activities will be minimal or symbolic.

As human systems demonstrate a tendency to organize so then a tendency to totalitarian institutions develop. This is problematic as it is a precursor to the next level of organization. This is systematization of torture. Heinrich Himmler of Nazi Germany is an excellent example.

Himmler was the architect of the German police state and the formation of the death camps. In this degree he began experiments with gassing undesirables to alleviate the stress to German soldiers from having to shoot untermenschen or undesirables. Here history has documented the systematic isolation and genocide against Jews, Roma (gypsies) criminals, gays and lesbians, and those with various biological problems as subject to "the struggle for the extermination of any sub-humans, all over the world who are in league against Germany, which is the nucleus of the Nordic race; against Germany, nucleus of the German nation, against Germany the custodian of human culture: they mean the existence or non-existence of the white man; and we guide his destiny." (Himmler 1936). By 1933 Himmler had organized the first concentration camp in Dachua.

The argument here is how is it possible for an individual as Himmler to organize material and human resources of the state to arrange for the systematic genocide of a specific group of persons without be checked? Here is the context of being dependent to a fatalistic organization. By the time the Allies had entered the death camps in France after D-Day upwards of 6 million people had died.

A dependent circular pattern of abuse emerges. The culture itself has a basis for supporting these organizations. Hitler, Goebbels, and Himmler did not act unilaterally. An essentialist perspective at times eliminates the perspective that these operatives had to have organization. The dark point here is that the culture had to have in its basis a foundation for the agents of social control to manipulate. One cannot one hundred percent rule out biological sources but such are beyond any demonstrable proof. In their activities the organization of a paramilitary and military system with obstruction from the courts was essential to perpetuate these horrific acts.

The culture of impunity in itself does not exclusively pertain to genocide or acts of mass destruction. The systematic alienation of rights can begin with only an individual and marginally expand. This may seem incredible but culture itself is not created overnight. Many events as Darfur and the Holocaust have historical antecedents, which are thousands of years old.

Here we cannot models of totalitarianism as Convergent Totalitarianism and Oligarchical Totalitarianism. Here there is a simple loss of right to the government. In this context those in power gain in status and wish to obtain social power from gaining power and or property. This does not exclude systems that claim to be religious, socialist, or communists.

In the new trajectory the business community is integrated as business expands such has the potential for its resources to be used against the community here the forces of social control simply co-opt the trade and economy to use as a weapon. This tactic is not new it is associated more openly with the Mafia as in Russia. Here although the majority of the population may not be in immediate danger of losing life. A systematic attempt is made to intimidate and extort activities from the population. The use of paramilitary forces in drug trafficking also reflects this pattern.

The United States is not immune from this totalitarianistic trend as domestic social disorders matize with the War on Terror. Here the miscalculation and escalation aid all persons engaged in criminal acts as the government attempts to maintain social order and defend its borders.

In close the concept of an emergent worldview of the culture of impunity is correct in that most models of culture are abstract and artificially culturally neutral. They do not take into account that the natural human does have a potential for abuse. The current levels of historical cultural outputs must integrate into the models the contingencies of reality. The models of totalitarianism do at least focus on the creation of totalitarianism.

Dehumanization and the Oppressed

Dehumanization is a term that is used to denote a psychological process where one’s opponent is viewed as less than human and not deserving of moral and legal consideration. This activity results in strained relationships between the two parties with hatred and alienation towards conflict.

Psychology describes the formation of this enemy image. This is the use of the stereotype. The need for group identity is often an unmet need in the formation of these images. There is an exclusive disjunctive contrast in the formation of enemy images. Concrete actions of opponents are thought to reflect fundamentally evil traits or motives. Communication between the two parties becomes problematic or non-existent lacking in commonality. Circuitous thinking and irrational loops of thought are used to handicap thinking that supports obtaining victory at all costs to punish or destroy the enemy (Pruitt & Rubin 1994).

One of the consequences of the axiology of dehumanization is that the oppressed must learn not to become the oppressors. In the connection the tactics used by oppressors to create the lesser of two evils to justify a replication of their psychopathy will not be directly addressed here. Paulo Freire has philosophically pursued the axiological and historical context of dehumanization (Freire 1993):

Because it is a distortion of being more fully human, sooner or later being less human leads the oppressed to struggle against those who made them so. In order for this struggle to have meaning, the oppressed must not, in seeking to regain their humanity (which is a way to create it), become in turn oppressors of the oppressors, but rather restorers of the humanity of both.

Freire discusses a great humanistic task of the oppressed to liberate themselves and their oppressors. The oppressors “cannot find the power the strength to liberate the oppressed or themselves”. The false charity of the oppressors is only used to continue the oppression. The unjust social order that arises manifests itself as the dispensers of false generosity “become desperate at the slightest threat to its source”. Freire also give an assessment that “They will not gain this liberation by chance but through the praxis of their quest for it, through their recognition of the necessity to fight for it.” (Freire 1993).

Stalin and Censorship as a Model

Joseph Stalin is an important figure in using the state as instrument to censor and control mass perceptions. The conditions in the Unites States demonstrate an imitation and mimicry of certain historical tactics that have worked in the short term to hide and distort actual historical events that did occur to institutionalize mechanisms of abuse. This is done by developing traits that are inherent in the human species and other cultural behaviors and indentities that are learned through a continuum of experience.

Censorship is the use of governmental power to control speech and other forms of human expression. It is most commonly applied to acts which occur in public circumstances, and generally involves a suppression of them by criminalizing their expression. What is censored may range from specific words to entire concepts, and the ostensible motive of censorship is to stabilize or improve the society over which the government has control.

Sanitization (removal) and whitewashing (from whitewash) are almost interchangeable terms that refer to particular a form of censorship via omission, which seeks to "clean up" the portrayal of particular issues and facts which are already known, but which may conflict with the official point of view. Political correctness may also become a form of censorship.

The scapegaots are the scapegaots with a few prizes who are individual deafeated but institutionalization and systematizing the mechanism is strengthened.

The police here LAPD are a minor group that represents Gay facism. They are tyranny of a minority under a tyranny of a majority, the Democrats and Republicans and other static members of society. This position is centered on species failure and not any other political ideology. The Delaware State Police are set up to be the heores but are in actuality implicated. Intermediary are the Baltimore Studio which uses a Synclavier sampling piano to mutilate evidence. The Baltimore Police are remain in the background.

The best class as a group are those persons under 14 years of age. College age persons are openly recruited and are every bit as bad as any civil rights disorder of the 1960s of which students state they helped support. This a case of reversed polarites and being dependent puppet actors of this mechansim which is defection under prisonner's dilemma.

The mainstream media as TimeWarner, Associated Press, United Press International, and as well as cable providers as CNN have to realize that they are in a pay for coverage market environment.
